The spiced meat is often a combination of lamb, beef, pork and chicken. It is most often topped with tomatoes, onions, and tzatziki sauce, which is a mixture of yogurt, cucumbers, onion and garlic. The gyro is traditionally a Greek food, but is served all over the world. In Greece, gyro meat is most popularly pork or beef and the sandwich is served with french fries. In the U.S., gyros are made most often with lamb and the tzatziki sauce is often called cucumber sauce. The U.S. version of the sandwich is often over-stuffed, making it difficult to eat without being a bit messy. The gyro sandwich is also popular in France and Australia. Many countries call gyros by another name. Yiros in South Australia, churrasco grego (or Greek barbeque) in Brazil, doner in Turkey, taco el pastor in Mexico, kebab in Malaysia, and even in Athens, Greece, the term souvlaki is synonymous with gyro. Although the origins of the Greek specialty are not known, the father of the Gyros is considered to be George Apostolou or Papa George who was the first man to successfully market and promote the food. He brought the sandwich to the United States in 1965, to a restaurant in Chicago, Illinois. Soon other restaurants became interested in serving the sandwich and eventually George sold his restaurant to start Central Gyros Wholesale, a manufacturing company that sold its gyro sandwiches to food-serving establishments across the country. By James Chen When beginning a series of qi gong exercises, or at points between other exercises, it is common practice to use the following position, called Wu Ji. This position lets the practitioner refocus their energy and feel balanced again before moving on to the next exercise. As an initial exercise, it lets the practitioner become aware of their body and in touch with how they are feeling. Awareness is directed away from the surroundings and to the body, away from the external and to the internal, so that the student gains a new sense of themselves and their body. But the position is more than just physical in the practice of qi gong. It is also rather spiritual in nature. It is thought to be a way to connect the physical with the mental and the spiritual. It is believed to be a way to reach the access point to the primordial state, to the nothingness from which we came and to which we will eventually return. It is in a way, a kind of physical meditation. While performing this pose, the practitioner should empty their mind of any thoughts, cares or concerns, and instead focus on the sensations that they are experiencing in their body. Do not be concerned if you find that your thoughts are straying from your body and what it is feeling. This is a natural occurrence and the way that we normally function in life. But you are retraining your mind to focus its attention on the body, and doing so takes discipline. You will improve at your ability to maintain your concentration as you practice, just like with any other skill that you learn. Start by standing with your feet touching, but if this is not possible, it is still ok to stand with the feet about a foot apart. Feet should be firmly planted and kept pressed flat upon on the floor with the toes pointing directly forward. Legs should be strong and firm, but the knees should be slightly bent in order to prevent the inhibition of the circulation. Your arms should be relaxed and hang gently to your sides. Both of your wrists and hands should also hang loosely by your sides. Your palms should be turned so that they are facing the tops of your thighs. Balance and center your weight and relax the entire body from the head to the feet. Focus your attention on each major muscle group and watch it relax, moving from downwards until the body feels solid and heavy with relaxation. Now relax your face muscles, but keep your head erect. The flat of the top of your head should be parallel to the ground and you should keep your eyes focused straight ahead of you. Allow your mouth to relax with your lips slightly open. Breathe deeply and evenly, inhaling through your nose and out through your mouth. If you are a student of yoga, you will probably recognize this pose as being similar to the Mountain Pose, or Tadasana. If it helps you to imagine yourself as a mountain, than do so. Meditate or if that sounds too mystical just close your eyes and focus on your breathing, feel it as it goes in and feel it go out. Can you feel it flow through your nostrils into your lungs? Connect with your inner child - Do a handstand or a cartwheel - this isn’t going to work indoors but if you’re wearing trousers there’s no reason why you can’t do it in the park on your way to meet your date. Go somewhere private and be as unbelievably angry as you possibly can and try to stay angry - you’ll find that 9 times out of 10 you won’t be able to sustain it. The idea is not to get all worked up and then go and spray your anger at your date. It’s about getting it all out and then dealing with whatever situation needs addressing. In order to do this you need to make sure that you don’t leave your private space until you feel like your anger has all gone. We hear so much about anger management when it’s not really about managing it, but rather letting it out. Just remember the golden rule: its OK to get angry but its not OK to take it out on someone or something else. 8. They take real effort — things like: admiration, commitment, dedication, devotion, forgiveness, encouragement, strength, inspiration, motivation, understanding, compassion, hope, desire, steadfastness, and so much more. What people don’t realize (when they enter relationships) is love, though a beautiful thing, takes honest-to-goodness work — on both ends. If one can imagine two halves of an element - one side cannot function properly without the other; thus, it takes two halves to form a whole system of energy. A good example of what can transpire (in scientific terms), is the splitting of an atom. So long as the neutrons are coupled with protons, the atom is complementary…peaceful. In other words, the two halves make a harmonious whole. When separated, the atom becomes volatile, explosive and lethal. It is this combination that acts in accordance to each other. This analogy is a perfect example of what love relationships are supposed to accomplish. (1 person + 1 person = 1 Whole.) Two persons, in love, enter into a “whole” relationship. What is often misconstrued is how effectively two individuals are driven to work together. The initial notion is that, in a love relationship, each is to supply 50% to achieve 100%. This assumption could not be further from the truth. In love relationships, individual partners must contribute one-hundred percent to one another. There is no 50/50, 70/30, 0/100…only 100/100. If we think in terms of jobs or school tests — when we give only 50 percent, then we’re obviously failing miserably at our job or in school. If we give 70 percent, we’re just holding our heads above water, but we’re not truly happy. But if both partners give 100 percent, they’re passing with flying colors…they find peaceful contentment and can reap the rewards of what a love relationship is supposed to be. Any goal, even in love, can be reached when we commit ourselves to giving our all. Love relationships are a growing experience, and the longer we are committed to our partner, the more changes and growth will occur over time. How we adapt to those changes and growth (with our own response mechanisms) is entirely up to us. When encountering difficult situations (in love), we try to discover the root cause; or we backtrack our steps to see what went haywire. It’s a natural reaction. Instead of focusing on what went wrong, we need to redirect our attention to “what went right.” Yes, what went right. If we preoccupy ourselves with all the “bad” or “negative” events in our lives, then we are doing a disservice to not only our emotional wellbeing, but our physical wellbeings as well. Let’s think about that phrase: what went right? When we gear our mental plane toward the positive happenings, encounters, and love in our lives, we are creating a more open-minded proactive atmosphere that allows us to find compassion, understanding and yes, true love. So what’s all the hype about love relationships? Love relationships can bring happiness, empowerment, positivity, and even inspiration. When was the last time you told your partner that you loved him/her? The last time you held hands? Kissed? Took a walk along the beach together? Embraced each other? Window Box Gardening Tips And Techniques

By Mary Hanna In this country, window box gardening offers apartment dwellers the enjoyment of container gardening from within or without. If you live in just one room or on a very small property, you, too, can have a window box garden filled in spring with pansies and primroses, in summer with petunias or fuchsias, and in fall with chrysanthemums. In winter, greens and berries, like bittersweet or California pepper berries with pine, give color. English Ivy will provide trailing green all winter if kept out of the wind. For the best results in a window box gardens, the box ought to be at least three to four feet long but not more than six feet. If larger, it is way too heavy to suspend and secure properly, and it cannot be lifted easily, even by two people. Boxes resting on broad window ledges and on firm porch railings might be eight feet long, but hardly more since moving them becomes too hazardous. Keep to a minimum depth of eight to nine inches, with a width of ten to twelve inches across the top. Of course, lengths must vary according to the window, or series of windows or railing to be decorated with window box gardening. The most common material for window box gardens is wood. California redwood becomes a neutral gray if not painted, and cypress will last for years. Cedar is recommended, as is a good grade of white pine. Other materials include metals, which are attractive and, for the most part, light in weight. However, they have the disadvantage of conducting heat, thus overheating the soil in your window box garden. Other suitable and durable lightweight materials are plastic, fiberglass, spun glass, and Gardenglas. If you are handy with tools, you can make your own window boxes of wood, following instructions in pamphlets from your nursery or garden center. Whatever plan you follow, get boards one to one and a quarter inches thick. (Thinner boards will warp and offer little insulation against summer heat.) To fasten, rely on brass screws rather than nails, which in a few years may push out and cause a box to fall apart. To make corners secure, reinforce with angle irons. Be sure to provide enough drainage holes in the bottom for water to pass through freely. Space half-inch holes six to eight inches apart when building your window box gardens. When boxes are completed, treat the insides with a preservative to prevent rotting. Cuprinol or some other non-toxic material is excellent, but avoid creosote which is poisonous to plants. After the preservative has dried, apply at least two coats of good paint or stain. Select a color which will not detract from the plants. Traditional dark green is satisfactory, though commonplace, unless you use a tint like apple green. Have in mind the colors of the flowers, especially of plants that trail over the sides. Dark flowers do not show up against dark paint. The same is true of white flowers against light surfaces, as white petunias against white or pale yellow boxes. To hold window box gardens securely, use bolts or lag screws and treat them beforehand to prevent rusting. Leave an inch or so of space between the window box garden and house for the movement of air. If the box garden is to rest on a terrace or other solid surface, raise them on cleats or set up on bricks or blocks of wood so drainage holes won’t become clogged. Some space under boxes is also important for air circulation, which will dry up run-off water. When you plant a window box garden, put an inch layer of broken flower pots, crushed brick, small stones or pebbles over the bottom to enable water to escape freely through the openings. Above this, spread a piece of wet burlap or a layer of moist sphagnum moss, old leaves, hard coal clinkers or cinders to prevent soil from washing into the drainage area. All plants in window box gardening need rich soil for luxuriant growth. Space larger kindsgeraniums, coleus, and fuchsias-eight to ten inches apart; smaller kindslobelias, annual phlox, wax begonias, sweet alyssum, and browalliasix inches apart. An eight-inch-wide box accommodates two rows of plants, with the tall ones in back and the low ones along the front. Boxes, ten inches wide, take three rows of plants, tall, medium, and low for edging. After planting, spread an inch mulch of peat moss or other mulch over the soil to delay drying out and keep weeds in check. In a month, give a liquid fertilizer and follow up with feedings every seven to ten days. Foliage fertilizers can also be applied, but only as a supplement to root feeding. The choice of plants for window box gardens is limited only by size. Plants over a foot high do not look well unless boxes are exceptionally large. Otherwise, you can grow almost anything you want. For early spring, you might start with Dutch flower bulbs. In cold regions, these can be purchased already grown, or you can raise your own. Try hyacinths with pansies or early tulips or daffodils interplanted with grape hyacinths, or basket-of-gold and arabis with scillas, chionodoxas, or leucojum. Include some English daisies and sweet-smelling wall flowers, so common in window box gardening in Western Europe. Violas, blue phlox, aubretia, and forget-me-nots are other possibilities. The favorite plant in window box gardening is the geraniumred or pink for white, cream, or light or dark blue boxes; white for brown, blue, or red boxes. The familiar trailing variegated vinca is excellent with them. Thriving in sun or shade, the vinca needs constant pinching to prevent it from becoming too long. English and German ivies are other trailers for sun or shade. In the sun, low annuals, dwarf marigolds, lobelias and verbenas make nice edgings as does sweet alyssum, in white, purple or lavender. Petunias vie with geraniums in popularity, and any kind can be planted, though the balcony types have the advantage of trailing gracefully over the sides of the window box garden. In shade that is open to the sky, as on the north side of a house, coleus grows superbly, with white-and-green kinds a handsome contrast for those with red-and-pink leaves. Coleus luxuriates in a rich soil and requires plenty of moisture. Pinch to keep bushy, and to improve appearance remove the spiked blue flowers, unless you especially like them. The Trailing Queen coleus is one of the best. Other shade-tolerant trailing plants include English ivy and its varieties, creeping jenny, Kenilworth ivy, creeping fig, German ivy, variegated gill-over-the-ground, myrtle, wandering Jew, zebrina, achimenes, chlorophytum, star of Bethlehem or Italian bellflower, and strawberry begonia. These are just a few hints on planting your window box gardens. Be creative with colors and texture. Window box gardening, so much like container gardening, will become your next favorite hobby. By Laura Ciocan Most men and women put on weight differently. But on what makes fat settle in a preferential way, there is little evidence. Scientists ascertained that the specific body shapes are: the android shape, or apple shape, common among men (fat deposits on the middle section of the body, mostly on the abdomen) and the gynoid, or pear shape, more common among women (fat deposited on hips and bottom). There is also the third type of body shape: the ovoid shape, not differentiating between men and women. With this type we can speak of an over-all general coverage of bodyfat. Thinking of many cases of exceptions, I try to find out in what follows if there is a strict specific fat pattern distribution for men and women and what are the factors influencing fat distribution. And I find this interesting not in as much as the aesthetic side is concerned but from the health perspective. Being overweight or underweight are characteristics depending on many factors: you are genetically overweight if you have a family history of overweight parents/relatives. Also, the nervous system plays an important role in balancing the body weight: serotonin and endorphins send signals to the brain that induce the need to eat or on the contrary. There is also the CCK hormone which transmits the brain signals on the state of satiety - it decreases hunger. While generally, body weight is influenced genetically, hormonally and by the body maintenance condition (the activity routine), it seems that the fat distribution is influenced by age, genetic inheritance, race, but to a greater extent by gender specific hormones. They are responsible for the distribution of fat in certain zones of our bodies: thus, estrogens which are responsible of the typical female sexual characteristics will influence the fat deposition in the pear format, favouring its laying on the hips, thighs, and belly, while testosterone will “lead” fat mostly towards tummy and upper body. Latest studies show that men’s tendency towards the gynoid format has increased in the past 30 years (one study shows a growth of 2 inches in men’s hips in the past 30 years). According to researches as John R. Lee, M.D (specialist in natural progesterone therapy), Dr. Jesse Hanley and Dr. Peter Eckhart, it seems that modern life exposes people to increased amounts of estrogen and estrogen-like substances (xenoestrogens or foreign estrogens). Sources of these substances can be plastics, plastic drinking bottles, commercially raised beef, chicken and pork, personal care products, pesticides, herbicides, birth control pills, spermacide, detergent, canned foods and lacquers. The problem is that increased estrogen levels in men not only make their hips fatten but are the main risk factor for disease such as prostate enlargement and cancer. Also, for women, the android pattern fat distribution should raise questions with regard to hormonal imbalances, such situations being a potential cause for health problems such as polycystic ovary syndrome. We’ve seen how health related problems can affect body fat, now let’s take a look at how fat can induce health problems. It is clear that increased body fat affects health, the news is that its distribution on the body influences the state of health of specific organs. According to its placement, fat can be subcutaneous (under the skin) or visceral (around organs). The greatest concern is generated by visceral fat that can interfere with the good functioning of vital organs. There is a relationship between overall fat deposits and specific fat deposits: fat around the body middle section is associated with visceral fat, so, abdominal fat is the most serious health risk. The waist to hip ratio is a method of determining whether there are excessive amounts of upper body fat. It is obtained by dividing the waist measurement by the hip measurement. The upper limits are:.95 for men and .80 for women. Any exceeding values should be alarming. Apple-shaped fat individuals are exposed to a greater risk of developing obesity-related diseases, as the fat is intra-abdominal and distributed around their stomach and chest. They risk: Cardiovascular diseases and hypertension Type 2 diabetes Respiratory diseases (sleep apnea syndrome) Some cancers Osteoarthritis The pear-shaped overweight persons are at greater risk of mechanical problems, as most of their body fat is distributed around their hips, thighs and bottom. Both apple-shaped and pear-shaped obese persons are likely to develop psychological problems and alteration of the quality of life. In any case, extra-weight cannot create but problems. Fact is that the main role in acquiring extra-fat is the food intake that the body cannot burn for various reasons (such as a decreased metabolic rate, low activity level or the physical condition), and, consequently, it creates fat deposits. The solution is a classic one: diet and exercise. However, in shedding extra weight there are men-women differences. The process appears to be harder for women. The total mass of the body is made up of fat mass and fat-free mass. The fat mass can be of two types: essential and excess. Essential fat is found in bone marrow, in various organs, and throughout the nervous system. Women are at a disadvantage, as their physiological processes (childbearing and hormone functions) require a plus of essential fat, the “sex-specific fat”. Thus the total percentage of body fat is higher, moreover, this part of essential fat is hard to dislodge. George Michael’s Dispute with Sony Music

Nowadays contracts deal with almost every aspect of the lives of our contemporaries, starting with a wedding and ending with contracts involving giant companies. A contract in these cases is a certain guarantee that is obtained by both sides. Guarantees, in the first place of getting exactly what they want and for the amount of time they want to. A contract, when signed should be analyzed by experts in order to find any possible gaps in it. Gaps, that eventually can be fatal for the person, who signs it. This issue especially concerns, as well, people who deal with the musical industry. Due to its changeability it is very important to be able to foresee the possible sides that can be reviewed. Because this future changes can cost quiet a bit. For example a singer can loose his voice or decide to change his recording company being on top of thing. Of course it is not possible to take every possible change in count, but still a deep analysis is required. An objective analysis will always help in deciding on how important the issue of the argument and the way the present conflict can be solved. When a person is already under the contract there are not many ways of changing anything. So all the thinking should be done beforehand. If we take, for example, contracts with record companies, singers and artists should be very attentive, too. Michael began his career by forming the pop duo Wham! together with his best friend Andrew Ridgeley in the early 1980s. His work covers a variety of pop styles, from ballads to funky dance tracks. In a career spanning nearly 20 years, George Michael has been responsible for more than 75 million album sales. He is definitely related to the group of the most popular singers of the last 20 years. And has won the recognition of million of people. Of course such a popularity always goes on the same path with detailed observation of everything going on in the stars life. It especially concerns court cases and any difficulties with the law that the artist can possibly have. There are not many court cases involving serious disputes between artists and recording companies over contracts, and although there have been disputes, these often relate to other issues. From the point of view of a recording company a contract remains a contract, no matter what happens, excluding the articles discussed in the paper itself. Sony has always created high quality contracts and Georges Michael suit, dealing with getting freedom from the companys policy was a great deal for both sides. To get inside the very sense of this case we need to understand the situation that was back in 1992-1993. For a long time George Michael was satisfied with the contract and his career was going upstairs. He recorded songs that had very high sales. Of course, Sony, as a well-known company that knows the musical audience very well did have certain restrictions towards Michaels songs. It wanted certain music from Michael, music that would be popular among the audience 100% and it did have the experience to claim that. The company constantly investigates the popularity of different kind of music and has reasonable facts for not wanting the singer to change his musical direction or so. It seemed that it was a question of creative freedom that was not given by Sony, according to Georges Michaels words, but at the same time during the court case Michael named both Tommy Mottola, and another of his close business associates at Sony, Don Ienner as the people he blamed for souring his attitude towards Sony. That gave the case a negative color from Michaels side, because it started including emotional aspects. Artistic freedom was what George Michael urged and he was ready for anything to fight for it. At that moment Michael had followed up the best-selling album Faith with Listen Without Prejudice Volume I, which sold to a far more selective audience. Sony had to deal with a major grievance from George Michael. Relations between Michael and Sony got worse to a point in October 1993 when he started legal proceedings against the company to get out of his contract. Of course George Michael tried first to solve the problem without any court introduction, but could not manage it. He tried to make the hearings happen sooner, but the judge, Mr. Justice Knox, rejected a plea by Michaels lawyer, Mark Cran, to bring the case to court in June. And in stead of this the hearing was in October. Though Michael was disappointed with that, Michaels solicitor, Tony Russell, said that October was not the worst case direction. And added that it could have happened even two or three years later if the case had to wait its turn. Another wrong step that was made by Michael was his massive campaign about Sony being undertaken for Mariah Carey (who was later to marry the Sony boss Tommy Mottola).Sony responded properly and said that it was a provocation not based on any valuable facts. Such conduction was not on Michaels hand. And the legal forces supported Sony. The case lasted from October 1993 till July 1994. Sony is musical recording giant and being involved in such a law case was a big matter for them. It was their priority to win the case to show that the company was, is and will be very competitive. Among George Michaels complaints was that the companys American branch was not prepared to support the singers change of career direction, as evidenced by their handling of Listen Without Prejudice. And George Michael seeking artistic freedom was a case of honor to win in front of all the world audience. According to Michaels attorney, the singers decision to not appear in his own music videos was a major factor in the suit: Following the success of Faith, Michael felt that he needed a change of direction–he wanted to concentrate on his music and play down the image of being a sex symbol…He was entitled by his contract to make these decisions, but at the same time he realized he needed the cooperation of the record company, and was anxious that it should support him…However, he felt that his record company in the United States was not prepared to do this. So from George Michaels words he wanted no more to be a sex symbol and the company pushed on him. But the pressure was fair for being a pop-star for so many years, and being a sex symbol too does put certain obligations of the star. So when George Michael called his collapse in relations with the record label irreversible and said he wanted out of a contract that tied him down for the rest of his career - was not completely honest towards the companys policy. He wrote a 66 page-long statement concerning his complaints against Sony Music. Michael claimed the 15-year contract he signed with Sony amounts to unfair restraint of trade for the rest of his career. Michael insisted that he was made to sign the contract in 1988 after Sony took over his old label, CBS United Kingdom. Gordon Pollock, Sonys attorney after all these accuses Michael performed in court did not hesitate is accusing George Michael in being a super-rich pop star with an oversexed image who had broken many promises and contracts. His statement was supported by numerous examples. Though Michael decided to tone down his image as a sex symbol because as he claimed he had grown out of it and become more serious he had nothing to say when Mr. Pollock suggested the star had manipulated his earlier, sexy image, made particular use of the pelvic waggle and knew he risked losing fans by later changing that look. Michaels lawyer, Mark Cran, said his client wasnt just trying to wriggle out of the eight-record, $16 million contract signed in 1988. Its about an agreement which binds George Michael for the whole of his professional career in terms which are capable of being worked to his substantial disadvantage, said Cran. George Michael, who was looking forward his divorce from Sony faced a big gap in his career. And a lot of problems in connection with that. And though he insisted on courts declaration of his Sony 1988 contract null and void he made a lot of wrong steps and failed the case. The results of the court were that the Sony deal was reasonable and fair. George Michael blamed his Sony management team for the rift. In conclusion he added that he expected that the consequence of his new direction would be a loss of sales. He cannot blame Sony for the fact that he was right. He was left facing a legal bill in the around 7 million and was not released from the contract. And only in July 1995, Sony agreed to release Michael from his contract in return for the rights to a greatest hits package, a share in the profits from future albums, and a $40 million lump sum from his new labels, Virgin in the UK and DreamWorks in the US. And when Sony finally gave freedom to the pop-star Sony declared to the disappointment of the audience that both parties have agreed to keep terms of the agreement confidential. And as the result of improper steps the only thing George Michael could say was: I am shocked at the judgment. It means that even though I created and paid for my work, I will never own it, or have any rights over it. Perhaps, if he would not have made several statements and would not have included emotional aspects to the court the results would have been different. But for now this case is a good example from which certain lessons should be taken. George Michael did swear he would never deal with Sony again. Nevertheless he continued and renewed his contract with Sony. On of the primary reason he declared was the change of the label boss Tommy Mottola. And only now he revealed to the audience that former Sony Music boss Tommy Mottola was at the centre of his decision to quit the record label in 1993 and fight Sony Music for his artistic freedom in court. So even swearing he would never have anything in common with Sony after the failure in 1993 court case Michael resigned with the record company last year. The decision by itself is very surprising and does make people to change their understanding of the 1993 court case. It had everything to do with Mottola leaving. I never had any problems with Sony in the UK, but America holds the purse strings that is what Mr. Michael says, letting the whole court big case concentrate in his own words :If you fall out with the boss, youre in trouble. Business is always a relationship of serious people that do not let any emotions in the financial and business matters. It is not a place where you can blame what is happening only on one of the sides. If George Michael would have shown more flexibility, tolerance and cold-objective understanding of the situation he would not have gone to court in the first place. Speaking about contracts it is very important to say that the major thing is compromises, because both sides have to benefit from the union. 11 years after fighting, at a personal cost of 2 million and George Michael still returns to Sony. It was a brief summary of everything that happened in court, but generally, the core of the dispute had two main issues. Speaking court language, George Michael alleged that his recording agreement with Sony was void or unenforceable on two counts: As an unreasonable restraint of trade. As an agreement which infringed Article 85 of the Treaty of Rome (which, broadly, prohibits anti-competitive agreements). This two main problems turned out to be a huge court case that George Michael was not ready for. Just to refresh the situation before it the original contract was signed in 1984 with Wham! duo. When it broke up, the agreement continued spreading on George Michael and the contract was revised in 1988. In this contract it was taken into account that George Michael became a solo-singer and the popularity he obtained as being one and he signed he contract. So later George Michael argued on many things, argued that a number of terms of the 1988 agreement were unreasonable restraints of trade: 1. Exclusivity - broadly, he could not record or perform for third parties. 2. Duration of the contract - it was argued that the term of the 1988 agreement was capable of exceeding 20 years. 3. Post-term re-recording restrictions - this prevented him recording a relevant composition for a third party for up to five years from the date of recording. 4. Sony was not contractually obliged to release his records. 5. Royalty provisions - it was argued that these were inequitably weighted in favor of the record company. 6. Artistic control - over which he alleged he had no control. Of course, he had a right to argue on that, but he was well acquainted with the contract when he signed it. This six main arguments were reviewed by the judge in detail. In his analysis he turned to certain important facts. In the first place he said that the 1988 agreement was a compromise agreement of a restraint of trade issue. It was also about certain public interest and promises which had to deal with the contract signed by George Michael. Then, he also added that it would be unjust to Sony to review the 1988 agreement as unenforceable or void contract on he basis that George Michael received numerous expert legal advice at all times. One other thing that the judge pointed out was that George Michael was already a superstar when he decided to renegotiate the 1988 agreement and had declared the 1988 agreement void on the basis of restraint of trade, after he found out it was possible to do. It is possible to name three questions that are the major considerations in a case relying on the common law doctrine of restraint of trade: Does the restriction protect a legitimate interest or does it go further than merely giving reasonable protection to the party in whose favor it was granted? Is the interest of the party being restrained? Is the restriction reasonable in the public interest? All of the above were reviewed by the judge and deeply analyzed by him. The conclusion, the verdict of the judge was that though law doctrine of restraint of trade can be used with contracts like that, taking in account the peculiarity of his one, it can not be applied to it. He declared this contract to be a special one, an exclusion. The judge also made a strong stress on the Sony Music interests in this case, for they had made certain investments in the development of George Michaels career as an artist and it is natural that they want to sell as many records as it is possible. Financial expert David Ravden drew up the audit report to show all the gains made by the record company from its exploitation of the singers music. The report was aimed to show all profits derived by Sony from the exploitation of Michaels music. And Gordon Pollock successfully argued on certain parts of the audit report performed by George Michael. According to the rule of judge Jonathan Parker some part of audit reports performed by George Michaels as evidence in his restraint of trade case against Sony Music were inadmissible. According to these three questions the judge declared his verdict. The judge said the agreement was both reasonable between the parties and reasonable in the public interest. George Michael did not prove that Sony Music has obtained an unfair advantage by acting in a morally reprehensible way. The case could be improved by changing George Michaels behavior and making him try not to get everything at once. The change of his strategy would have been beneficial for him. If the case would have been viewed in a close meeting, and not demanding so much at once George Michael definitely had a chance to win. But suing such a giant company, and accusing it of so many things was ,no doubt, pointless. George Michael was young and ambitious and could see the achievement of his goal only through public. This kind of strategy was inappropriate with major companies. He tried to prove something to Sony through the court case, making loud statements. And almost not having required evidence. But speaking specifically, George Michael should have insisted on voiding the 1984 contract in the first place and he also should have gone for partial freedom first in couple of issues, and later on of the rest. The aggressive point he took did not bring him any advantages over Sony. He only aroused the backfire reaction. One of his primary mistakes was being to affirmative in the accuses he made in front of Sony Musics face. The company had made a great a great investment in him and the points had to do with some payback that it required in any contract. It is a well-known business contract scheme: favor-payment. And when on of the sides gets a share from a contract and does not pay back to the other side it can be called no following the articles. And it is a serious matter that can be taken to court. In the very beginning of this paper we said couple of words of he importance of a contract that is signed and once again we want to turn to it. George Michael had obligations in front of recording company that had been providing its services to him for years, making everything possible to make his songs top-hits. Seeking for creativity freedom is an honestly good and highly respected thing. New direction of the singers music is a great idea, but this idea has to go along with the contract that already exists. A recording company is in the first place interested in the profit from the singers music, and is always beware of new trends that can be less popular among the audience. George Michael had a strong desire to change his image but did not take into account the public factor and from our point of view he was way confident in himself as a star. He forgot everybody is equal in front of the Court and everything is looked upon very objectively.George Michael did make mistakes that were the cost of this court case against Sony music. His demand could have been fulfilled but not in such a way and not all at the same moment. Mr. Michael had to be more patient and forward-looking, for this law suit brought him a lot of troubles, starting with the time he was in the process itself and ending with his recording problems. Yes, Mr. George Michael lost the case, but he definitely learned a good lesson from it. And one of the consequences of that is his renewed contract with Sony now, in 2004. The singer has signed to Sony in a deal that is thought to cover his extensive back catalogue. Mr. George Michaels accuses of Sonys attitude and professional slavery turned out to be a long year fight that could have been stopped long ago and not even get started. And his failure in his court wrangle with Sony in 1993 could not have happened either.
